c) Registration and access to the personal account
You can create a personal account by filling in the form on the appropriate page on the Site.
For registration and access to the reserved area, the user’s personal data and/or those that identify him (name and surname) are collected. You can also optionally provide us with any other data requested. The password will be automatically generated and sent by e-mail when creating the account and must be freely modified by the user, by following the security features set by the Owner (for example, number and type of usable characters).
When you have created your personal account, your page will store information relating to your identification and contact data, your orders and purchases (including payment methods and delivery or billing addresses), as you provide us with them to use of our services and purchase our products. You will always be able to manage your personal information and your history, directly from your account or by making a specific request. You will also have the option of cancelling your account and all the data stored therein at any time: in this case, some data must still be kept by Orthodontics High Design Srl for the periods of time required by applicable law (for example, billing related to purchases made). The cancellation cannot be made if there are still unfulfilled orders: in this case, we will ask you to wait for the completion of the procedure to obtain the cancellation of the account.

- Legal basis of the processing : to execute the contractual relationship which the interested party is part of (Article 6, paragraph 1, letter b GDPR ).
d) Purchase and shipment of products
It is possible to purchase the products available in the virtual catalogue on the Site: to access this function and complete the purchase procedure, you can first create a personal account or log in to your personal page, if you already have an account, or, if available, you can make the purchase in “guest” mode, providing us with the data necessary for payment, billing and shipping of the products.
Even if you already have a personal account on the Site, when you purchase products, we may need more information compared to those you used for the account (for example, payment method) or you may decide to enter some more information or change those previously saved in your account, for example by indicating a different shipping or billing address.
If you have already entered this information in your personal account, the data will be retrieved automatically when you log in, but you will always be able to change it. If you request the cancellation of your personal account, the data relating to the purchases made will be kept by the Data Controller for the time established by law, in particular in the tax and fiscal field.
Even if you purchase in “guest” mode, in relation to this service you will be able to receive communications via e-mail, concerning the purchase confirmation and the shipment of the products, as well as any interruption of the process (e.g. “abandoned cart”) or any problems (for example, in case of errors in the payment method). Furthermore, when you purchase products through the Site, some data (name, surname, shipping address) must be communicated to the courier appointed by the Data Controller to deliver the products.
- Pursued purpose: to make purchases of products through our e-commerce platform;
- Legal basis of the processing: the provision of the service you have requested and the execution of a contractual relationship which the interested party is part of (Article 6, paragraph 1, letter b GDPR).
e) Sending communications for marketing purposes in the context of legitimate interest and soft-spam
In some cases, we may use the e-mail address communicated by the user by using the site (for example, in the case of a personal account or the purchase of products or in the event of requests for specific products) to send some promotional communications, even without requesting prior consent to the user. This treatment will be carried out in compliance with the provisions of art. 6, letter. f), GDPR and art. 130, co. 4 of Legislative Decree 130/2003. In particular, users are informed of the processing activity through this information and they are always granted the right to oppose, easily and for free, to this processing: every communication sent by the Data Controller, in fact, contains the reference to this information and the indications on how to request the interruption of the treatment (through opt-out), by contacting the Data Controller or directly selecting the appropriate link made available at the bottom of each communication.
- Purpose of the treatment : to inform you about products similar to those of your previous purchase and of your possible interest;
- Legal basis of the processing : the regulatory provision pursuant to art. 130, paragraph 4, Legislative Decree 196/2003 which legitimizes the sending of communications regarding products or services similar to those already requested (Article 6, paragraph 1, letters c and f, GDPR).
f) Newsletters
The Orthodontics High Design Srl newsletter is sent via e-mail to those who explicitly request it, by filling in the appropriate form on the Site with their e-mail address and authorizing Orthodontics High Design Srl to process their personal data for the aforementioned purpose. The service is rendered exclusively upon explicit and unequivocal consent from the user (issued by selecting the appropriate box on the Site) and the provision of data is mandatory only for the purpose of receiving the newsletter and any refusal will make it impossible to use the service, without further consequences.

In any case, to no longer receive the newsletter, simply select the unsubscribe link at the end of each e-mail or send a specific request to the e-mail address privacy@orthodonticshd.com. The cancellation is managed in a partially automated way, so further newsletters could be received for a period following this request, in any case no later than 72 hours from the cancellation request, and whose sending was planned before the cancellation request was received.
- Purpose of the processing : to send to the interested party communications via e-mail relating to products and services of Orthodontics High Design Srl, news and updates on related topics, as well as offers and promotions reserved for subscribers to the service;
- Legal basis of the processing : the consent of the interested party (Article 6, paragraph 1, letter a, GDPR).
g) Cookies

6. How will you process my data?
Your personal data will also be processed with the aid of electronic means for the time strictly necessary to achieve the intended purposes with the collection.

7. Are my data processed outside Europe?
The data processed by Orthodontics High Design Srl are in servers located in Italy, provided by the company Serverplan srl.
At present, the cookies used are exclusively first-party. If third-party cookies are also used, we inform you that in this case personal data could also be transferred to servers located in the United States, considered by the European Supervisory Authorities as a country that does not offer guarantees of the same level as those provided by the GDPR for the protection of personal data. In these cases, therefore, the Data Controller will use these suppliers in compliance with the provisions of articles 45 and following of the GDPR. All necessary precautions will therefore be taken in order to guarantee the best possible protection of personal data by basing this transfer: a) on adequacy decisions of the recipient third countries expressed by the European Commission; b) on adequate guarantees expressed by the recipient third party pursuant to art. 46 of the Regulation; c) on the adoption of binding corporate rules, the so-called Corporate binding rules and, in particular, by preparing technical and IT security measures that protect personal data and the rights of data subjects in the best possible way, as required by the GDPR and European legislation .
8. How long will you keep my data?
Orthodontics High Design Srl will process your personal data for the time reasonably necessary to achieve the purposes listed above only, which can be examined in the section “ Which data will you process ? ” or for the terms established by sector legislation: for example, data relating to purchases made will be kept for the period established by tax and fiscal laws and indicatively for a period of 10 years. Furthermore:
– the data used to send the newsletter will be kept until your cancellation request;
– the data used for soft spam communications will be kept until your request for cancellation or for two years from the last time you expressed interest in Orthodontics High Design Srl (for example, by contacting us via the Site);
